A Lubbock man has been indicted for sexual assault of a family member.

KAMC News reports that 29-year-old James Garza, Jr. was arrested earlier this year for an incident that occurred in January.

The family member, who has not been identified, told police that Garza Jr. sexually assaulted them while they were asleep and that they woke up during the assault to Garza smelling of cigarettes, marijuana and alcohol. He allegedly asked the victim not to tell anyone and that he was sorry.

He was indicted on multiple charges Tuesday, July 30th, including sexual assault of a child, possession of marijuana, assault on a public servant, and failure to display a driver’s license.

Garza is still being held in the Lubbock County Detention Center with at least a $150,000 bond for the sexual assault charge.
