38-year-old Justin Musgraves, Lubbock's Deputy Director of Emergency Management who has been charged with possession of prepubescent child pornography, has pleaded not guilty.

KAMC News reports that a tablet owned by the City of Shallowater that was assigned to Musgraves in the past was dropped off at University Medical Center for software installation, and during the installation in September of 2020, sexual images and videos of underage girls were discovered.

It has been noted that it's unclear if Musgraves was the only person with access to this tablet prior to the discovery of these images and videos.

An officer noted that "Musgraves told me that he maintained a Microsoft OneDrive account that contained nude images but did not contain child pornography." Musgraves even provided written consent to search the tablet.

Musgraves' attorney, David Guinn, issued this statement:

Like every innocent person, Justin has tried to cooperate with the authorities to show them his innocence. We’re disappointed with the indictment. We look forward to seeing the evidence which we haven’t seen yet. It will be the strangest case of its type I have seen in 32 years.

Musgraves has been placed on leave without pay by the City of Lubbock as the investigation continues.

Musgraves has been allowed to go free on a $20,000 bond. He must provide a $2,000 deposit by 5 p.m. on Friday, February 19th.

Some conditions he must follow while out on bond:

  • no excessive use of alcohol
  • participation in a sex offender treatment program

If required by federal pretrial services, he will also have to agree to location monitoring.

The trial date has been set for April 5th.
