Former Lubbock County Commissioner Ysidro Gutierrez Reportedly Inquires About Creating Recall Petition Against Lubbock Councilman Victor Hernandez

A former Lubbock County officeholder has reportedly inquired about initiating a recall petition against a Lubbock City Councilman.

On his personal Facebook page Friday afternoon, District One Councilman Victor Hernandez posted that he has received an email from Lubbock City Secretary Becky Garza, saying that former Lubbock County Commissioner Ysidro Gutierrez came by her office to discuss forming a political action committee to initiate a recall against Hernandez.

In the email posted by Hernandez, Garza stated that her office provided Gutierrez with Texas Ethics Commission forms for PACs, and also referred him to the City Charter for the recall process.

In order to recall a Lubbock City councilperson, a qualified voter that resides in the councilperson’s district must file an affidavit, and get petition forms from the City Secretary’s Office.

The petition for a recall must be signed by 30 percent of qualified voters in the councilperson’s district. Garza stated that in District One, 448 valid signatures would be required, out of the 1,491 voters in the district. At least one-tenth of signers must certify that they voted for the councilperson in the election in which they were elected, and their signature on the petition is the same as having signed an affidavit.

The recall petition papers must be returned to the City Secretary’s Office within 30 days after the filing of the affidavit. The councilperson is then given five days after the petition is verified, and if the officeholder does not resign, the City will order a recall election.

The Lubbock City Council voted last night to hire outside legal counsel to review claims made against Hernandez by City Manager Lee Ann Dumbauld, and a complaint against Dumbauld by Hernandez.
