A man in San Antonio called police to report an abandoned baby during a winter storm. The mother was identified and later arrested.

Neglected Newborn in Texas

When the newborn was found, San Antonio was hitting highs of 28 degrees—far too cold for anyone to be left outside, let alone a newborn baby. My San Antonio reported that the man who notified law enforcement eventually confessed that he did know the mother and what apartment she resided in.

The baby was immediately taken to an intensive care unit and was deemed in critical condition.

Police soon learned, after speaking with the mother and nearby witnesses, that she had failed to properly care for the newborn after giving birth. This was when the man who made the 911 call took the newborn from the apartment to seek medical care after recognizing that the mother was failing to do so.

Ava Marie Guerra, 28, was arrested on Monday and charged with injury to a child and reckless serious bodily injury. Her bond was set at $150,000 which was soon paid, allowing her to be released from the Bexar County Jail.

Conditions tied to her bond include having zero contact with her child, GPS tracking and zero access to firearms, according to My San Antonio.

In Texas, ‘neglect’, when referring to childcare, includes placing a child in a situation that requires judgment or reactions beyond the comprehension and/or maturity level that they possess.

The Texas Secretary of State website also includes what constitutes medical neglect. This is the blatant disregard for the consequences of removing a child from immediate danger for the sake of their health or safety.
