The battle over school choice is heating up in Austin during the 88th Texas Legislature and this week a massive rally in favor of school choice may happen outside the Capitol building.

But before too much time was spent on the issue, some at least wanted to make sure that school choice was legal in Texas. In the opinion of Texas Attorney General Ken Paxton, the answer is yes.

According to a press release from Paxton's office, school choice is legal in Texas and lawmakers can pass legislation in favor of education savings accounts which is one of the primary ideas being debated.

“Texas parents should have the right to choose the best school for their kids, and every Texas child deserves the opportunity to attend a good, safe school where they can learn and thrive,” said Attorney General Paxton. “Today I issued a legal opinion which informs the Texas Legislature that there are no constitutional barriers to enacting school choice in TexasIt’s time to empower Texas parents and provide additional educational opportunities so every Texas child can reach their dreams.” 

That's at least one barrier that has been cleared before lawmakers really get deep into the issue which could happen any day now.
