The proposal for a memorial fountain has been withdrawn from the Lubbock City Council.

At Thursday’s meeting, District 3 Councilman Todd Klein had an item on the agenda for the City Council to consider a resolution directing City Manager Lee Ann Dumbauld to take the steps necessary to plan and design a water fountain in Mackenzie Park honoring the memory of Timothy Cole.

Cole, a military veteran and Texas Tech student, was wrongly convicted in Lubbock of raping another student in 1985. He died in prison of an asthma attack in 1999, and was granted the State of Texas’ first posthumous pardon from Governor Rick Perry in 2010.

Klein said that he withdrew the motion to allow for more discussion involving the type of memorial, and to allow Cole’s family to be involved in the discussion.
