A Texas man has been arrested for his alleged role in the death of his newborn grandchild after police say the baby was found in a trash can inside a Walmart restroom.

He is also facing a new charge that adds up to four charges so far.

Texas Newborn Dies After Being Left in a Walmart Trash Can

On Monday, July 14, Kingsville police were called to the Walmart location at East General Cavazos Boulevard after a store employee found a newborn baby abandoned in a restroom trash can. Officers attempted to save the baby's life, but the baby was pronounced dead at Christus Spohn Hospital.

The newborn's mother, a 17-year-old, was located and take to the hospital for medical assessment. At this time, it's not known if she will face any charges according to usatoday.

Grandfather Arrested After Newborn Baby Was Abandoned

According to USAToday, Jerry Lee Martinez, the grandfather of the newborn that died, has been arrested in the case and faces charges.

Martinez faces charges of abandoning or endangering a child with criminal negligence. He also faces charges of tampering with physical evidence with the intent to impair and tampering with a witness.

Grandfather Faces Additional Charge

According to KRIStv.com, the grandfather of the newborn, the father of the teen who gave birth, has now been charged with an additional crime.

The report says that Jerry Lee Martinez has now been charged with sexual assault of a child.

No details have been released regarding the charges. KRIStv did report that the teenage girl has been released from the hospital and is being kept in a "secure location" according to law enforcement.
