Sending Unwanted Nude Pictures Is Now Illegal in Texas
A new law, signed by Governor Greg Abbott in May, makes the electronic transmission of sexually explicit material a Class C misdemeanor when the recipient of such material hasn't provided consent. Offenders of the new law will also face a fine up to $500.
In other words, it's now a crime to send unwanted nude photos, video or other sexually explicit images without having consent from the person receiving the material.
Governor Abbott posted a video on social media about the new law, which goes into effect September 1, 2019.
All digital platforms used to transmit material, not just texts, will be subject to the law, including dating apps and social media.
Stop before you send and ask yourself, 'Does the person I'm sending this to want to see this?' If the answer is no, or if it's unclear, then the material shouldn't be sent to avoid the potential of facing charges.
