On the Wednesday edition of The Chad Hasty Show, U.S. Senator John Cornyn spoke with Chad Hasty about his newly proposed HUMANE Act and the ongoing border crisis.

In an article in the National Review, Cornyn explained that the recent surge of immigrants stems form criminal organizations exploiting a loophole in the 2008 immigration law, which prevents children from being detained by the Border Patrol and instead releases them to family members in the U.S, many of which are not legal citizens themselves.

Cornyn said that in his new act, the children coming over the border illegally would be detained instead of being released to family. After a few days, the children would then be able to contest to a judge whether or not they have a legitimate claim to be in the U.S. If the child does not have legitimate claim, they would then be sent back to their home country.

"What the HUMANE Act would do would be to treat these unaccompanied children from non-contiguous countries like Central America the very same way we currently treat the children unaccompanied from Mexico. So this is designed to try to stop the flow and to deter people from starting this long, perilous journey in the first place because the message is going to be, if we fix this by passing something like this, that you're not going to be able to stay. And that will be a deterrent."

The bi-partisan bill has also faced some bi-partisan criticism, with Democrats claiming the Act is too tough and some Republicans claiming it's not tough enough. Cornyn countered by saying his act would not dramatically change any existing immigration laws. He added that it would only expedite the deportation process, and prevent any of these children and their families from disappearing once they cross the border.

Cornyn also commended Governor Rick Perry's decision to send the National Guard to the border, saying that Perry has shown real leadership while Obama has been "missing in action."
