Texas Man Sues Whataburger For Almost $1 Million Over Wrong Order
A Texas man did what many Texans do on a daily basis, he walked into a Whataburger to order a meal. In July of 2024, Demery Ardell Wilson placed an order for a burger with no onions.
According to Yahoo News, the chain got the order wrong, and onions were indeed on the burger. And now he is suing.
Whataburger Sued for Nearly $1 Million Dollars
Demery Ardell Wilson is claiming that Whataburger "failed to act in accordance with the appropriate standard of care" when they served him a burger that had onions on it. Wilson had asked for no onions. According to NBC News, Wilson claims he suffered "personal injuries" due to the onions. Wilson claims he had an allergic reaction to the onions and required medical attention.
According to NBC, the filing claims that Whataburger was negligent by providing Wilson a meal that included onions and that those onions rose to the level of a "manufacturing defect".
Wilson is suing for over $250,000 but less than $1 million dollars.
Wilson Has Sued Fast Food Before
This isn't the first time the plaintiff has sued a fast food restaurant. According to NBC News, in May of 2024 he sued Sonic Drive-In, but the suit was dismissed.
