The nation’s highest court has refused to block a controversial abortion restriction in Texas.

The Supreme Court of the United States justices voted 5-4 to continue to allow the restriction requiring doctors who perform abortions in clinics to have admitting privileges at a nearby hospital.

Opponents say that the restriction has led more than a third of the state’s clinics to stop providing abortions, according to the Associated Press.

The restriction was approved by the Texas Legislature in July of this year.

Though the Supreme Court refused to block this enforcement, the case does still remain on appeal to the 5th U.S. Circuit Court of Appeals in New Orleans.

Arguments will likely be heard for the case in January, and it’s likely that the issue will go back before the Supreme Court after the appeals court issues a final ruling.
