A U.S. District Court of Appeals has overturned a ruling in an appeal by the City of Lubbock regarding a lawsuit by a former city employee.

Martha Ellerbrook sued the City of Lubbock after she was not hired amidst another lawsuit between her husband and the city. She was awarded almost a quarter of a million dollars by a jury, however the City of Lubbock appealed the decision, with Federal Judge Sam Cummings ruling in their favor.

The U.S. District court, in addition to overturning that ruling, instructed the District Court to enter a new judgment for Ellerbrook with consideration of her attorney’s fees. The City was also ordered to pay back all costs of the latest appeal.
