Tuesday, September 29, a Lubbock County grand jury has indicted two for their involvement in the death of a one-year-old baby boy, Mason Rodriguez.

The mother of the child, Madison Rodriguez (18), was indicted on capital murder charges, while Charles Flournoy (21) was indicted for injury to a child.

Mason Rodriguez was discovered not breathing and rushed to the hospital by EMS June 20. He later died.

According to officials, the mother admits to throwing Mason on the floor a few days before his death. Court records from July indicate Flournoy dropped Mason, resulting in the boy hitting his head on a toilet.

KAMC News reports that just last week Flournoy called the newsroom from jail saying he was innocent and was being falsely accused of murder.

He did not defend or accuse the mother.
