Texas Tech's head football coach Tommy Tuberville says he was a victim and not a guilty partner in an Alabama hedge fund which is being sued for allegedly defrauding investors.

Tuberville's attorney filed a petition in U.S. District Court in Montgomery, Alabama yesterday seeking to be dismissed for the lawsuit filed against him as a partner with David Stroud in their investment entity T.S. Capital Partners.

Tuberville said he never induced anyone to invest in the venture, which the plaintiffs say cost them 2 million dollars. Tuberville's petition says he himself lost 450,000 dollars given to Stroud to invest.

The plaintiffs' suit allege that Tuberville and Stroud failed to file tax returns and falsified fund performance reports.
