A Lubbock man has been sentenced to two years in prison for perjury.

Ernesto Garcia was sentenced Thursday to 24 months in federal prison and a term of three years of supervised release following his June 2013 guilty plea to one count of perjury.

According to the U.S. Attorney’s Office, Garcia perjured when he testified that he had no criminal record in a tax fraud case for San Juanita “Janie” Pena.

The government said that Pena had no home, residence, or place to live if she were released rather than being detained, and Pena called Garcia to testify on her behalf.

Pena testified that he could be responsible for her if she were released into his custody, and testified that he had no criminal record, when he was actually convicted in 1993 in Iowa for possession of a controlled substance.
