The U.S. Supreme Court has refused to stop the execution of a former Army recruiter and convicted killer who had received three previous stays of execution.

The court rejected Cleve Foster's appeals today just hours before he could be taken to the Texas death chamber for lethal injection. Foster was condemned for his role in the 2002 shooting death of a woman he and a friend met at a Fort Worth bar.

The gun Foster used in the murder was also used in the murder of Lubbock native Rachel Urnosky in 2002. Foster was never tried for the death of Urnosky.

This will be the 9th leathal injection in the State of Texas.
